Austrian Court Confirms Legality of ORF Levy

The Austrian Administrative Court has upheld the mandatory 15.30 Euro monthly household fee, dismissing legal challenges to the levy.

The Austrian Administrative Court confirmed the legality of the ORF household levy, rejecting legal remedies against the fee. Introduced in early 2024 to replace the device-linked GIS fee, the 15.30 Euro monthly charge applies to all households in Austria.

The ruling Ra 2025/15/0009 dismissed ten identical submissions, following a 2023 Constitutional Court decision. The ORF-Beitrags Service GmbH remains authorized to issue notices, despite 7,600 complaints previously pending at the Federal Administrative Court.

This decision clarifies that the financing restructure is not a new state aid requiring EU Commission notification. Citing European Court of Justice precedents, the court affirmed the levy is mandatory regardless of whether public programs are actually consumed.
