Ombudsman Urges Legal Framework for Youth Care

Austria's Ombudsman Board calls for a clear legal basis for facilities like Vienna's 'Auszeit-WG' to manage offenders under the age of 14.

The Austrian Ombudsman Board is demanding a clear legal framework for facilities like Vienna's 'Auszeit-WG' to address young offenders under 14. Ombudsman Bernhard Achitz argues current measures are ineffective for non-criminally responsible youth offenders.

Operating since July 2026 with provider 'neue wege,' the 'Auszeit-WG' uses the Heimaufenthaltsgesetz as a legal basis. However, Jurist Heinz Mayer and Vice-Mayor Bettina Emmerling warn this application is a constitutional breach and an inappropriate foundation.

Justice Minister Anna Sporrer plans to present a draft law by autumn 2026 focusing on child welfare. While some officials suggest lowering the age of criminal responsibility, Achitz advocates for educational measures over punishment to prevent youth crime.
